TERMS OF SERVICE — VOICE TYPER

1. WHO WE ARE

Voice Typer is developed and operated by Estri Tech, an individual developer based in New Delhi, India. References to "we", "us", or "our" in these Terms mean Estri Tech. References to "you" or "user" mean the individual using the application.

2. AGE REQUIREMENTS

You must be at least 13 years of age to create an account and use Voice Typer. If you are under 13, you may not use the application.

To purchase a Voice Typer Pro subscription, you must be at least 18 years of age, or the age of legal majority in your jurisdiction, whichever is higher. If you are between 13 and 17 years of age, you may only purchase a subscription with the express consent and involvement of a parent or legal guardian, who accepts these Terms on your behalf.

By using Voice Typer, you represent and warrant that you meet these age requirements. We reserve the right to terminate accounts that we reasonably believe are held by users who do not meet them.

3. LICENSE TO USE

Subject to your compliance with these Terms, Estri Tech grants you a personal, non-exclusive, non-transferable, limited, revocable licence to download and use the Voice Typer application on devices you own or control, solely for your personal or commercial purposes.

This licence does not permit you to:

• Distribute, sublicense, resell, or transfer the application to any third party.
• Modify, adapt, translate, or create derivative works based on the application.
• Remove, obscure, or alter any proprietary notices or labels on the application.

Voice Typer incorporates open-source software including PySide6 and the Qt Toolkit, licensed under the GNU Lesser General Public Licence v3 (LGPLv3). Use of these components is governed by their respective licences, which are available on request by emailing estritech@gmail.com.

4. DATA COLLECTION AND ANALYTICS

By using Voice Typer, you acknowledge that we collect usage metadata — such as session duration, engine used, and app interactions — to help us understand how the application is used and to improve it. We do not collect the content of your speech or your transcription text. Full details of what we collect, how we use it, and your rights are described in our Privacy Policy, which forms part of this agreement.

5. FREE TRIAL

New users receive a two-day free trial upon first installation, during which full Pro features are available without payment. The trial is tied to your device's hardware identifier to prevent repeated abuse through uninstall and reinstall cycles. Re-installing the application or creating a new account does not reset or extend the trial period.

After the trial ends, the application reverts to the free tier. Free tier limitations are: No word substitution, No Multiple language profiles, No Chirp Pro usage, No smart punctuation, No Customizing hotkey, no Toggle on/off activation, no automatic injection. You are limited to Standard engine, One fixed hotkey, One language at a time.

We reserve the right to modify, shorten, or discontinue the free trial offer at any time for new users without notice.

6. SUBSCRIPTIONS, BILLING, AND PAYMENTS

6.1 Subscription

Voice Typer Pro is available as a monthly recurring subscription at the price displayed at the time of purchase. The subscription grants access to Pro features as described in the application, including but not limited to custom hotkeys, multiple simultaneous language profiles, Smart Punctuation, text substitutions, the Chirp Pro speech engine (90 minutes worth of voice typing), and the typewrite input method (Automatic injection mode).

Included Chirp Pro usage is subject to a usage allocation as described in the application at the time of purchase. Usage beyond this allocation in a given subscription period is not guaranteed and may be made available as a paid add-on in future.

6.2 Billing

Payment is processed by DodoPayments, our third-party payment processor acting as Merchant of Record. By subscribing, you authorise DodoPayments to charge your payment method on a recurring monthly basis until you cancel.

Your subscription renews automatically at the end of each billing period unless you cancel it before the renewal date. You are responsible for monitoring your renewal dates. We do not send renewal reminders, and automatic renewal does not entitle you to a refund on the grounds that you did not intend to renew.

You can cancel your subscription at any time through the account section of the application or by contacting estritech@gmail.com. Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until that date.

6.3 Price changes

We reserve the right to change the subscription price at any time. If we increase the price, we will notify you by email at least 14 days before the new price takes effect on your account. Continued use of the subscription after the new price takes effect constitutes your acceptance of the new price.

6.4 Failed payments

If a payment fails, your subscription will be placed on hold. You will have the opportunity to update your payment method. If payment is not successfully collected within a reasonable period, your subscription will be cancelled and access to Pro features will be revoked.

6.5 Device limit

A single Voice Typer Pro subscription permits use on up to two devices simultaneously. If you attempt to activate the subscription on a third device, the oldest active device is automatically deactivated to make room for the new one. 7. REFUND POLICY

7.1 General policy

All subscription payments are final. We do not offer refunds for partial billing periods, unused Chirp Pro minutes, or subscription periods during which you did not actively use the application.

7.2 EU and UK consumers — right of withdrawal

If you are a consumer located in the European Economic Area or the United Kingdom, you have a statutory right to withdraw from a digital service contract within 14 days of purchase without giving any reason.

To exercise this right, you must contact us by email at estritech@gmail.com within 14 days of your purchase date. Your email must include the email address associated with your Voice Typer account and your payment reference or the approximate date of purchase so we can locate your transaction. We will process your refund through DodoPayments back to your original payment method within 14 days of receiving your valid withdrawal request.

This right of withdrawal applies to your first subscription payment only. It does not apply to subsequent monthly renewal charges once you have continued past your first billing cycle, as those renewals constitute a new affirmation of the ongoing subscription.

7.3 Goodwill refunds

Outside of the EU and UK statutory right described above, all payments are final. We may, entirely at our discretion, offer a refund in other exceptional circumstances. Contacting us does not guarantee a refund. Any goodwill refund we choose to issue is processed through DodoPayments back to your original payment method.

7.4 Account termination for abuse

If your account is terminated because you violated these Terms, including the fair use and prohibited conduct provisions in Section 9, your remaining subscription period is forfeited and you are not entitled to a refund for any portion of it, including any otherwise applicable EU or UK statutory right of withdrawal.

8. CHARGEBACKS AND PAYMENT DISPUTES

If you initiate a chargeback or payment dispute with your bank or card provider rather than contacting us first, the following applies:

We will contest any chargeback we believe to be unjustified. To do so, we reserve the right to submit evidence to DodoPayments and the relevant card network, including your account information, usage logs, login timestamps, hardware identifier records, and confirmation that Pro features were successfully delivered to your account.

In accordance with our agreement with DodoPayments, a chargeback initiated against a Voice Typer transaction results in a minimum dispute processing fee of 30 USD, GBP, or EUR, or INR 3,000, depending on your payment currency. By agreeing to these Terms, you acknowledge that if a chargeback is resolved in our favour, you are liable for this fee and any associated administrative costs.

A successful chargeback will result in the immediate and permanent termination of your Voice Typer account and a ban on the hardware identifier associated with that account. If you have a billing concern, please contact us at estritech@gmail.com before initiating a dispute. Most issues can be resolved quickly.

9. FAIR USE AND PROHIBITED CONDUCT

You agree not to:

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the application, or extract API keys, authentication tokens, or proxy server endpoints from it.
• Use automated scripts, bots, or any tool other than the Voice Typer application itself to send requests to our proxy server or authentication infrastructure.
• Intercept, modify, replay, or spoof network communications between the application and our servers or any third-party API it uses.
• Share your account credentials with other individuals or make your subscription available to more than two devices simultaneously through any means.
• Use the application to process audio belonging to a third party without their knowledge and consent.
• Attempt to circumvent, disable, or interfere with any security, trial enforcement, or device-limit mechanism in the application.
• Use the application in any manner that violates applicable law, regulation, or the rights of any third party.

Violation of any of the above may result in immediate account termination without refund and, where applicable, legal action.

10. SERVICE AVAILABILITY AND THIRD-PARTY DEPENDENCIES

10.1 No guarantee of uptime: Voice Typer is provided on an as-is, as-available basis. We do not guarantee continuous, uninterrupted, or error-free access to the application or any of its features. Temporary downtime may occur due to maintenance, updates, or circumstances beyond our control.

10.2 Third-party services: Voice Typer relies on third-party services including Google Cloud Speech-to-Text and Google's speech recognition WebSocket API. The availability, accuracy, and pricing of these services are controlled entirely by their respective providers. We have no control over and accept no liability for changes to, degradation of, or discontinuation of these services. If Google modifies or discontinues a speech recognition API that Voice Typer depends on, we will make reasonable efforts to provide an equivalent alternative but are not obligated to do so within any specific timeframe.

10.3 Discontinuation: We reserve the right to modify, suspend, or permanently discontinue Voice Typer or any specific feature, including the Chirp Pro engine, at any time. In the event of discontinuation, whether of the application as a whole or of a specific feature, you are not entitled to a refund for any remaining portion of your subscription period, except where required by applicable mandatory consumer law in your jurisdiction that cannot be excluded by contract.

11. INTELLECTUAL PROPERTY

Voice Typer, including its name, logo, source code, user interface, design, and all content created by us, is the intellectual property of Estri Tech and is protected by applicable copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership of intellectual property to you.

12. ACCOUNT TERMINATION

12.1 Termination by you: You may stop using Voice Typer at any time. If you wish to close your account, contact us at estritech@gmail.com and we will process your request within 30 days.

12.2 Termination by us: We reserve the right to suspend or permanently terminate your account if we determine, in our reasonable judgement, that you have violated these Terms, engaged in fraudulent or abusive behaviour, or created legal or financial risk for us or other users.

12.3 Effect of termination: Upon termination of your account, your licence to use Voice Typer ceases. Any hardware identifier bans applied as a result of abuse or fraudulent chargebacks are permanent. Local data stored on your device is not automatically deleted and must be removed manually if desired.

13. DISCLAIMER OF WARRANTIES

To the maximum extent permitted by applicable law, Voice Typer is provided on an as is and as available basis without warranty of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy of transcription output, or non-infringement. We make no warranty that the application will meet your requirements, operate without interruption, or be free from errors or security vulnerabilities. Speech recognition transcription may contain errors and should not be relied upon for any purpose where accuracy is critical.

14. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Estri Tech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business opportunity, arising out of or in connection with your use of or inability to use Voice Typer, even if we have been advised of the possibility of such damages. Our total cumulative liability to you for any claims arising under these terms shall not exceed the total amount you paid to us for the Voice Typer Pro subscription in the three months immediately preceding the claim.

15. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Estri Tech from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to your use of Voice Typer, your violation of these Terms, or your violation of any rights of a third party.

16. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms or your use of Voice Typer that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction located in New Delhi, India. Before initiating any formal legal proceedings, you agree to first contact us at estritech@gmail.com and allow 30 days for us to attempt to resolve the dispute informally.

17. CHANGES TO THESE TERMS

We may update these Terms from time to time. When we do, we will update the date at the top of this document. For material changes, we will notify you by email at the address associated with your account or through a notice displayed within the application, at least 14 days before the changes take effect.

18. MISCELLANEOUS

If any provision of these Terms is found to be unenforceable or invalid, that provision will be enforced to the maximum extent permissible and the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Estri Tech regarding your use of Voice Typer.
